These terms & conditions apply to all of our services made available online or on any mobile device or by email. By accessing, browsing and using our website or any of our applications through whatever platform (hereafter collectively referred to as the “website”) and/or by completing a booking enquiry, you acknowledge and agree to have read, understood and agreed to the Terms and Conditions set out below including the privacy statement. Please read this page carefully. If you do not accept the Terms and Conditions stated here, do not use the Site.

We may review these terms and conditions and revise them at any time by updating this posting. You should visit this page periodically to review the Terms and Conditions, because they are binding on you and each time you use the Site you agree to be bound by the current terms and conditions.

Definitions

“The Company” means WonderBars, Suite 5377, 26 Upper Pembroke Street, Dublin 2, an Irish registered company.

“Platform” means the website on which the Service is made available owned, controlled, managed, maintained and/or hosted by WonderBars.ie

“Service” means the online booking enquiry service of various products and services as from time to time made available by Suppliers on the Platform

“Supplier” means the provider of venues (bars, clubs, hotels, theatres, conference halls), tours, tour operators and any other related product or service as from time to time available to make an enquiry about on the Platform.

Scope of our Service

Through the Platform, The Company (and its affiliate/ distribution partners) provide an online platform through which Suppliers can advertise their products and services for enquiry and through which visitors to the Platform can make such enquiries. By making an enquiry through WonderBars.ie you are submitting a (non-binding) booking enquiry to the Supplier about a product or service. From the point at which you submit your booking enquiry, we act solely as an intermediary between you and the Supplier, transmitting the details of your booking enquiry to the relevant Supplier(s) and sending you a notification email that your booking enquiry has been sent to the Supplier.

When using our services, the information that we disclose is based on the information provided to us by Suppliers. Although we will use reasonable diligence and care in the carrying out of our services we will not verify if, and cannot guarantee that, all information is accurate, complete or correct, nor can we be held responsible for any errors, any interruptions, inaccurate, misleading or untrue information or non-delivery of information. Each Supplier remains responsible at all times for the accuracy, completeness and correctness of the information displayed on our Platform. Our platform does not constitute and should not be regarded as a recommendation or endorsement of the quality, service level, qualification or rating of any Supplier (or its facilities, venue, products or services) made available.

Our Service is made available for personal and noncommercial use only. Therefore you are not allowed to resell, deep-link, use, copy, monitor (eg. spider), display, download or reproduce any content or information, software, products or services available on our Platform for any commercial or competitive activity or purpose.

Booking Enquiries

The Platform provides the function to submit a booking enquiry to the Supplier. The booking enquiry is a request by you sent via the Platform to the Supplier for information as to the availability of certain products and services offered by the Supplier on The platform.

You can make a booking enquiry on the Platform by providing details about your enquiry. Details include; number of persons, date requested for the enquiry, time requested for the enquiry,  type of product or service requested, full name, email address, telephone number, any other information.

Enquiry Date Calendar

You may see this message on the enquiry date calendar “Enquiries accepted for this date”. This means that the Supplier may accept booking enquiries for this date. It does not mean the supplier has availability on this date or is obliged to hold or assign this date for you. Certain date restrictions may apply depending on the Supplier.

Enquiry Time

Once a date is selected you will then be asked to request a time for your enquiry. The times displayed on the Platform are the only times the Supplier has made available to make a booking enquiry for that specific date choice. Times may change depending on the date selected.

Enquiry Persons

You are required to enter the requested number of persons for your booking enquiry. There may be a minimum amount of persons and a maximum amount of persons allowed according to each Supplier. All persons must be over the age of 18 to be included in the booking enquiry request. The Supplier may have a different age policy and it is recommended that you request the age policy from the the Supplier directly. Please be aware that the Supplier’s age policy can vary. (examples include aged over 18, aged over 21, aged over 23 and aged over 25)

Estimated Prices & Quotes

Any prices quoted on the Platform are estimated prices and therefore should not be relied upon as the final price a Supplier may charge for any services or products advertised on the Platform. The Supplier may change estimated prices quoted on The Platform at any time and without notice to you. The Platform does not facilitate any payments between you and a Supplier. All payments required in respect of any booking enquiry (product or service) are made directly between you and the Supplier.

Deposits

A Supplier may or may not require a booking deposit to confirm a booking (either refundable or non-refundable). The Supplier booking deposit may be an additional fee added to any estimated price quoted on The Platform (including if the estimated price quoted is €0.00).

The Platform does not facilitate any deposit payments between you and a Supplier. All deposit payments required in respect of any booking enquiry (product or service) are made directly between you and the Supplier.

Availability & Confirmation

All booking enquiries made through the Platform are subject to confirmation from the Supplier. The Supplier will contact you directly (by using the contact details provided at the time you made the booking enquiry – normally email or telephone number). You will not receive a confirmation email from The Company or The Platform to confirm or reject a booking enquiry sent to a Supplier using The Platform. It is at the sole discretion of the Supplier to reply or respond to a booking enquiry sent by you to them via the Platform. The Company cannot guarantee that any booking enquiry or communication will be (duly and timely) received/read by, complied with, executed or accepted by the Supplier.

Supplier Terms & Policies

Please be aware that all Suppliers may have additional policies including but not limited to specific booking terms & conditions, age policy restrictions, door policies, health and safety policies.  It is recommended that you request this information from the the Supplier directly.

Age

The Platform is strictly for use of those persons aged 18 years and over. You are not permitted to visit, browse or submit a booking enquiry on the Platform if you are under the age of 18. Please also note that, when making a booking enquiry, the Supplier may have an age policy requirement that is older than 18 years of age to avail of the products and services it offers and it is recommended that you request the age policy from the Supplier directly.

Free of Charge

Our service is free of charge. We will not charge you for our service or add any additional fees.

Suppliers pay a fee to list their products & services on the website to The Company

Communication

By submitting a booking enquiry, you agree to receive an email we may send you shortly after you submit your booking enquiry to notify you that your booking enquiry has been sent to the Supplier(s). This email may contain certain information and offers relevant to your booking enquiry. We may also send you an email inviting you to complete a review form. Please see our privacy statement for more information on how we may contact you.

In order to duly complete a booking enquiry submission your correct email address must be used. We are not responsible for (and have no obligation to verify) any incorrect email address or incorrect telephone number.

Reviews

A completed review may be uploaded onto the relevant Suppliers information page on our Platform to inform others publicly of your opinion of the service and quality of the Supplier and also (wholly or partly) used and placed by the Company at its sole discretion (e.g. for marketing activities, promotion or making improvement of our service) on our Platform or such social media platforms, newsletters, special promotions, apps or other channels owned, hosted, used or controlled by the Company. We reserve the right to adjust, reject, delete or remove reviews at our sole discretion.

Disclaimer

Neither The Company nor any of our officers, directors, employees, representatives, subsidiaries, affiliated companies, distributors, affiliate (distribution) partners, licensees, agents or others involved in creating, sponsoring, promoting, or otherwise making available the website and its contents shall be liable for (i) any punitive, special, indirect or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, loss of claim, (ii) any inaccuracy relating to the (descriptive) information (including prices and descriptions) of the Supplier as made available on our Platform, (iii) the services rendered or the products offered by the Supplier or other business partners, (iv) any (direct, indirect, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, pursuant to, arising out of or in connection with the use, inability to use or delay of our Platform, or (v) any (personal) injury, death, property damage, or other (direct, indirect, special, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, whether due to (legal) acts, errors, breaches, (gross) negligence, willful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by or (wholly or partly) attributable to the Supplier or any of our other business partners (including any of their employees, directors, officers, agents, representatives or affiliated companies) whose products or service are (directly or indirectly) made available, offered or promoted on or through the Platform, including any (partial) cancellation, overbooking, strike, force majeure or any other event beyond our control.

By uploading photos/images onto our Platform you certify, warrant and agree that you own the copyright to the photos/images and that you agree that The Company may use the uploaded photos/images on its (mobile) website and app, and in (online and or offline) marketing, promotional materials and publications and as The Company at its discretion sees fit. You are granting The Company a nonexclusive, worldwide, irrevocable, unconditional, perpetual right and license to use, reproduce, display, have reproduced, distribute, sublicense, communicate and make available the photos/images as The Company at its discretion sees fit. By uploading these photos/images the person uploading the picture(s) accepts full legal and moral responsibility of any and all legal claims that are made by any third parties (including, but not limited to, venue owners) due to The Company publishing and using these photos/images. The Company does not own or endorse the photos/images that are uploaded. The truthfulness, validity and right to use of all photos/images is assumed by the person who uploaded the photo, and is not the responsibility of The Company. The Company disclaims all responsibility and liability for the pictures posted. The person who uploaded the photo warrants that the photos/images shall not contain any viruses, Trojan horses or infected files and shall not contain any pornographic, illegal, obscene, insulting, objectionable or inappropriate material and does not infringe any third party (intellectual property right, copyright or privacy) rights. Any photo/image that does not meet the aforesaid criteria will not be posted and/or can be removed/deleted by The Company at any time and without prior notice.

 

Intellectual Property Rights

The software used and required for our services and Platform and the intellectual property rights (including the copyrights) of the contents and information on our Platform are owned by The Company, its suppliers or providers.

The Company exclusively retains ownership of all rights, title and interest in and to the Platform on which the service is made available (this to include all intellectual property rights & the design of The Platform, and reviews). You are not permitted nor entitled to copy, scrape, link to, publish, promote, market, integrate, utilise, combine or use the content or our brand without express written permission. To the extent that you would (wholly or partly) use or combine our content (including reviews) or would otherwise own any intellectual property rights in the Platform or reviews, you hereby assign, transfer and set over all such intellectual property rights to The Company. Any unlawful use or any of the aforementioned actions or behaviour will constitute a material infringement of our intellectual property rights including copyright and database right.

General

Any disputes, claims or proceedings arising out of or in any way relating to the Platform or content displayed on it shall be governed by the laws of The Republic of Ireland. The Irish Courts shall have exclusive jurisdiction for the purpose of any proceedings arising out of or in any way relating to the Platform.

We may at any time and without liability modify, suspend or discontinue the Platform or any content (or any part or specification thereof), with or without notice, for any valid technical, operational or commercial reasons.

Any changes to these Terms and Conditions will be posted on the Site and will take immediate effect.
